Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you (or the organization you represent) (“you”) and AnswerScout (“AnswerScout,” “we,” “us,” or “our”). They govern your use of the AnswerScout service at answerscout.ai and app.answerscout.ai (the “Service”).

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

AnswerScout is a subscription software service that monitors AI assistant responses across multiple engines (including ChatGPT, Gemini, Claude, Perplexity, and Grok) to track brand visibility — whether and how AI systems mention your brand when users ask category-level buying questions.

2. Accounts and Access

2.1 Eligibility. You must be at least 18 years old and capable of forming a binding contract to use the Service. If you use the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.

2.2 Account registration. You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. By creating an account, you agree to our collection and use of product and website analytics as described in the Privacy Policy.

2.3 Acceptable use. You agree not to:

  • Use the Service to track brands you do not have authority to monitor commercially
  • Attempt to reverse-engineer, scrape, or replicate the Service's data or methodology at scale
  • Submit prompts or brand content that is defamatory, harassing, or illegal
  • Circumvent any rate limits, access controls, or subscription restrictions
  • Use the Service for any unlawful purpose or in violation of any applicable laws

2.4 Account termination by you. You may cancel your account at any time from the billing settings page. Cancellation takes effect at the end of the current billing period.

3. Subscriptions and Billing

3.1 Plans. AnswerScout offers the following paid subscription plans (pricing and features subject to change with notice):

New accounts start with a 7-day free trial at Starter-level access, with no credit card required. When the trial ends, you must choose a paid plan to continue using the Service — there is no free tier, and access is paused until a plan is selected.

3.2 Billing. Subscriptions are billed monthly in advance. Payment is processed by Stripe. By subscribing you authorize us to charge your payment method on each billing cycle.

3.3 Failed payments. If a payment fails, we will retry per Stripe's retry schedule. Continued failure may result in downgrade or suspension of your account.

3.4 Refunds. We do not offer refunds for partial billing periods. If you cancel mid-cycle, you retain access through the end of the paid period.

3.5 Price changes. We may change subscription prices with at least 30 days' email notice. Your continued use of the Service after the change takes effect constitutes acceptance of the new price.

3.6 Taxes. Prices exclude applicable taxes. You are responsible for any taxes owed on your purchase.

4. Intellectual Property

4.1 Our IP. AnswerScout and its underlying software, scoring methodology, visual design, and content are owned by AnswerScout or its licensors. Nothing in these Terms grants you ownership of any part of the Service.

4.2 Your data. You retain ownership of the brand names, prompts, competitor lists, and other content you input into the Service (“Your Content”). You grant us a limited, non-exclusive license to use Your Content solely to provide the Service to you.

4.3 Feedback. If you submit ideas, suggestions, or feedback about the Service, you grant us a royalty-free, perpetual license to use that feedback without restriction or compensation to you.

5. AI-Generated Content and Accuracy

5.1 Third-party AI results. The Service queries third-party AI engines (ChatGPT, Gemini, Claude, Perplexity, and Grok) and returns their responses. We do not control, and are not responsible for, the content of those AI-generated responses.

5.2 No guarantee of accuracy. AI engine outputs are probabilistic and change over time. Results reflect the AI's response at the time of the query and may not accurately represent how the AI will respond in the future, or how end users experience those systems. AnswerScout is a monitoring and research tool — results should be used as directional signals, not as definitive conclusions.

5.3 No endorsement. Mention or analysis of competitors within the Service does not constitute an endorsement or a claim about any third party.

6. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, ANSWERSCOUT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ANSWERSCOUT'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) $100.

IN NO EVENT WILL ANSWERSCOUT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

8. Indemnification

You agree to defend, indemnify, and hold harmless AnswerScout and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

9. Modifications to the Service and Terms

9.1 Service changes. We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable advance notice for material changes that significantly reduce functionality.

9.2 Terms changes. We may update these Terms at any time. For material changes we will email you at least 14 days in advance. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

10. Termination

10.1 By you. You may cancel at any time as described in Section 2.4.

10.2 By us. We may suspend or terminate your access immediately if you violate these Terms, if required by law, or if continued operation would harm the Service or other users. We will provide notice unless prohibited by law or immediate action is required to prevent harm.

10.3 Effect of termination. Upon termination, your right to use the Service ceases. We will delete your data in accordance with our Privacy Policy. Sections 4, 6, 7, 8, and 11 survive termination.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the federal or state courts located in Ohio, USA, and you consent to personal jurisdiction in those courts.

12. Miscellaneous

12.1 Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and AnswerScout regarding the Service and supersede all prior agreements.

12.2 Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

12.3 No waiver. Failure to enforce any provision of these Terms is not a waiver of our right to enforce it in the future.

12.4 Assignment. You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger or acquisition.

12.5 Force majeure. We are not liable for failures or delays caused by circumstances beyond our reasonable control, including acts of God, internet outages, third-party service failures, or government actions.
